What Is Premises Liability?

Property owners have a legal duty to maintain their premises in a reasonably safe condition. When they fail to do so and someone gets hurt, they can be held liable for the resulting injuries.

In Georgia, the duty owed depends on why you were on the property. Invitees — people invited onto the property for business purposes, like customers in a store — are owed the highest duty of care. Property owners must inspect for hazards and either fix them or warn visitors.

To succeed in a premises liability case, you generally need to prove that the property owner knew or should have known about the dangerous condition, that they failed to take reasonable steps to fix it or warn about it, and that this failure caused your injury.

Challenges in Slip and Fall Cases

Slip and fall cases can be challenging to prove. Property owners and their insurance companies often argue that the hazard was obvious, that you weren't paying attention, or that they didn't have time to discover and fix the problem.

That's why it's critical to document everything as soon as possible after a fall. Take photos of the hazard that caused your fall, get names and contact information of witnesses, report the incident to the property owner or manager, and seek medical attention promptly.

The sooner you contact an attorney, the better. Evidence disappears quickly — floors get mopped, conditions get fixed, and surveillance footage gets overwritten.

What Property Owners Argue

  • "The hazard was open and obvious"
  • "We didn't know about the condition"
  • "You weren't paying attention"
  • "Your injuries aren't that serious"
  • "You were wearing improper footwear"
